Idaho water director won't reconsider decision

TWIN FALLS, Idaho — Idaho Department of Water Resources Director Dave Tuthill has turned down a request from the U.S. Bureau of Reclamation asking him to reconsider his decision in a years-old water delivery case.

Tuthill's decision clears the way for a court challenge.

The case involves a call for water made by seven water users known as the Surface Water Coalition. The group — which includes the Twin Falls and North Side canal companies — has sought since January 2005 to shut off groundwater users who they said were depriving them of their full, senior water rights.

Idaho law gives water rights to individuals and companies based on seniority. Generally, those holding the oldest water rights have priority in accessing limited water supplies.
